Before buying, selling, gifting or mortgaging property, the title has to be checked and the documents have to be right. Batavia Legal handles title investigation and conveyancing for flats, offices and land in Mumbai and Thane.
A title certificate is an advocate's written opinion on whether the owner has clear and marketable title. It rests on the chain of title documents and a search of the Sub-Registrar's records, usually covering about 30 years, together with the 7/12 extract or property card and the society's records where relevant. Banks require one before sanctioning a home loan, and buyers and developers rely on it before signing.
Copies of the existing title documents, the latest index II, the share certificate and society NOC for a flat, the 7/12 extract or property card for land, tax receipts, and any loan or mortgage papers. If you are a buyer, bring whatever the seller has shared so far.
It depends on how old the property is, how many transfers there have been and how quickly the records can be inspected. A simple flat in a registered society can be quicker than land with several past owners.
Often, yes. Depending on the defect, it may be cured by a rectification deed, a confirmation deed from the original parties or their heirs, or a supplementary document, which is then registered.
