Civil litigation and arbitration lawyers in Mumbai

Batavia Legal acts in civil, commercial and property disputes before the Bombay High Court, the City Civil and Commercial Courts in Mumbai, and arbitral tribunals.

Courts and arbitration

Commercial disputes above the specified value are heard by the Commercial Courts or the Commercial Division of the Bombay High Court under the Commercial Courts Act, 2015. Before filing most commercial suits that do not seek urgent interim relief, the claimant must first attempt pre-institution mediation under section 12A of that Act.

Where a contract has an arbitration clause, disputes go to arbitration under the Arbitration and Conciliation Act, 1996. The courts can grant interim protection under section 9, appoint an arbitrator under section 11, and hear challenges to an award under section 34.

Common questions

Should I send a legal notice before filing a case?

In many disputes a legal notice is the first step. It sets out the claim, gives the other side a chance to respond, and some laws require one before proceedings can begin.

What is a summary suit?

A summary suit under Order XXXVII of the Code of Civil Procedure is a faster procedure for money claims based on written contracts, bills of exchange or similar documents. The defendant has to obtain leave of the court to defend.
